This Cancellation Policy constitutes a binding contractual framework governing the cancellation, modification, and termination of any booking or service. Upon confirmation of any reservation, the Traveller/Agent irrevocably agrees to comply with the terms herein. Cancellation requests shall be processed strictly in accordance with defined timelines, supplier policies, and operational constraints, and may attract cancellation charges up to 100% of the booking value. Journi Trail™ DMC reserves the absolute right to determine applicable charges and processing conditions in line with supplier terms and prevailing circumstances.
1. Introduction
The policy is published on the official web portal accessible at: https://journitrail.com/legal/cancellation-policy/
2. Scope & Applicability
This Cancellation and Modification Policy (“Policy”) shall govern all bookings, reservations, and service arrangements made through the Company, whether directly or through authorized agents, partners, or intermediaries. The Policy shall be deemed an integral part of the contract between the Company and the Client upon confirmation of any booking.
This Policy applies to all bookings, quotations, invoices, and transactions, whether made via website, email, WhatsApp, phone, or through agents/partners. All cancellations, amendments, and refunds shall be governed strictly by this Policy, irrespective of booking source or communication channel.
This Policy shall apply to all services offered by the Company, including but not limited to flight bookings, hotel accommodations, holiday packages, land arrangements, ferry services, cruise services, ground handling services, and any ancillary or add-on services booked as part of or in connection with the travel arrangement.
The Policy shall be applicable to all categories of bookings, including individual, group, corporate, FIT (Free Independent Traveller), fixed departure, promotional, discounted, or any other form of booking, whether confirmed fully or partially, and irrespective of the mode of booking or payment.
The Policy shall become effective from the moment a booking is confirmed, whether through issuance of a booking confirmation, invoice, voucher, system-generated confirmation, or upon receipt of any advance or partial payment, whichever is earlier, and shall remain in full force and effect until completion, cancellation, modification, or termination of the booked services.
This Policy shall be binding upon all clients, travellers, agents, corporate entities, and any third parties acting on behalf of the end user. The Policy shall apply irrespective of geographical location, destination, currency of transaction, or supplier jurisdiction.
Wherever applicable, supplier-specific terms and conditions (including those of airlines, hotels, transport operators, or third-party service providers) may apply in addition to or in precedence over this Policy, subject to contractual obligations and operational requirements.
By confirming a booking, the Client expressly acknowledges, agrees, and accepts this Policy in its entirety, and waives any right to dispute or challenge its applicability, except as may be expressly provided under applicable law.
3. General Cancellation (Regular Cases)
3.1 Booking Cancellation - General Customer Request
This policy shall apply irrespective of any internal payments made by Journi Trail™ DMC to vendors, suppliers, partners, DMCs, hotels, resorts, villas, flight operators, tour operators, or consolidators, and no liability shall arise on the Company for such cancellations.
All activities and experiences marked as “Non-Refundable” on the vouchers shall not be eligible for any refund under any circumstances, and such cancellations shall result in a zero refund. Similarly, any cancellation of flights, hotels, experiences, ferry services, cab transfers, or any other travel components marked as “Non-Refundable” on the final travel vouchers shall not be eligible for refund, and the customer shall be entitled to a zero refund. No-show cases shall also be treated as “Non-Refundable” cancellations.
Cancellation Charges (From Date of Booking - DOB):
- 90–60 days prior to DOT: B.AMT++ + TAC++ + TSC++ + TCS (if applicable) + Remittance Fee + Transaction Charges + 0% Package Cost
- 60–30 days prior to DOT: Above charges + 30% Package Cost
- 30–10 days prior to DOT: Above charges + 60% Package Cost
- 10–0 days prior to DOT / No-Show: 100% of Total Booking Value (No Refund)
All charges are cumulative, mandatory, and non-negotiable.
Non-Refundable Bookings: For any booking marked “Non-Refundable” or governed by strict supplier terms, 100% of the booking value shall be forfeited, irrespective of reason. The cancellation charge slab structure defined above applies only to eligible refundable components.
Customer Assurance & Flexible Services Policy: For specific tours, experiences, transfers, or villas (as explicitly identified at the time of booking), cancellation may be permitted up to 48 hours prior to the scheduled service with eligibility for up to 100% refund, subject to service-specific terms, operational feasibility, and deduction of applicable transaction/statutory charges. The term “easy refund” or similar expressions shall be construed as a service facilitation commitment and not a legal guarantee.
3.2 Booking Cancellation – Due to Non-Confirmation Clause
The Company reserves the right to cancel or release any booking in the event of non-confirmation from any resort, hotel, villa, ferry operator, airline, or supplier due to supplier-side constraints. A booking may also be cancelled due to delay, non-payment, or missing documentation from the traveller/agent end. Provisional itineraries or tentative references shared prior shall stand automatically cancelled with zero validity.
3.3 Booking Cancellation – Due to Non-Availability
In the event that any booking cannot be confirmed due to overbooking, inventory restrictions, or operational limits, the Company reserves the absolute right to cancel such booking in whole or part without liability. Received payments shall be refunded, adjusted, or converted into credit notes as per supplier policies. Alternative services may be offered at revised pricing without obligation of parity.
3.4 Booking Cancellation – Due to Flight Cancellation
If any flight connected to a booking is cancelled, rescheduled, or delayed by the airline, the Company shall not be liable for the impact on land arrangements. Cancellation requests shall be treated as voluntary with standard charges applying up to 100%. Refunds depend strictly on airline recoveries, and rebooking costs are borne entirely by the Traveller/Agent.
3.5 Booking Cancellation – Due to Geopolitical Situation
Disruptions arising from war, civil unrest, political instability, border closures, diplomatic tensions, or government advisories shall be treated as Force Majeure. Remedies (rescheduling, travel credit notes, partial refunds, or service substitutions) depend entirely on supplier recoverability. The Company assumes no liability for consequential visa, insurance, or incidental costs.
3.6 Booking Cancellation – Due to Disaster Management
Cancellations arising from natural disasters (floods, earthquakes, cyclones), epidemics, pandemics, or government disaster management directives shall be treated as Force Majeure. The Company shall pass on only such amounts as actually recovered from suppliers, after deducting administrative and service charges.
4. Cancellation by Operational & External Dependencies
The Company reserves the absolute right to cancel, modify, suspend, or withdraw any service due to operational constraints, third-party actions/omissions, technical failures, staffing constraints, or logistical challenges. The Company acts solely as an intermediary and shall not be liable for direct or indirect losses caused by external dependencies.
5. Service-Type Based Cancellation Rules
5.1 Booking Cancellation – Hotel & Land Services
Governed strictly by supplier-specific agreements; charges vary from nominal fees up to 100% retention. Land transfers, tours, passes, and activities once issued are non-refundable, non-transferable, and non-reusable. No-shows and auto-cancellations due to payment defaults result in zero refund. Offline confirmation windows require 48–72 hours.
5.2 Booking Cancellation – Flight Only Services
Flight cancellations are governed strictly by airline fare rules. Non-refundable tickets or no-shows attract 100% cancellation charges. Missing or invalid passports/visas are treated as non-refundable cancellations. Refunds, where applicable, are calculated solely on the base fare/ticket value (excluding taxes, convenience fees, and commissions). Travellers must report at least 2 hours prior to departure. Internal vendor communications and group PNR details are strictly confidential.
5.3 Booking Cancellation – Hotel Only Services
Governed by the provisions detailed under Clause 5.1.
5.4 Booking Cancellation – Land Only Services
Governed by the provisions detailed under Clause 5.1.
5.5 Booking Cancellation – Ferry Only Services
Speedboats, longtail boats, public ferries, and inter-island vessels operate under local operator rules. Tickets are non-transferable and non-reusable. Weather disruptions, tidal variations, and safety cancellations are subject to operator refund policies. Failure to report at the boarding point within prescribed reporting times constitutes a no-show with zero refund.
6. Payment & Commercial Non-Compliance
6.1 Booking Cancellation – Delay or Non-Payment
Failure to adhere to payment schedules constitutes a material breach. The Company reserves the absolute right to cancel or auto-release bookings without notice, resulting in 100% forfeiture and zero refund, irrespective of voucher markings. Reinstatement requests are treated as fresh bookings at prevailing market rates.
6.2 Automated Payment Reminders
Automated reminders are courtesy facilitations only. Non-receipt, spam filtering, or delivery failure does not waive payment deadlines or prevent auto-cancellation.
6.3 Add-On Supplement Payment (Third-Party Services)
Optional third-party services (visas, green taxes, city taxes, room decorations) are non-refundable and non-transferable once initiated. The Company does not guarantee visa outcomes or authority clearances.
6.4 Non-Refundable Bookings (Supremacy Clause)
Any booking or service explicitly marked “Non-Refundable” attracts 100% cancellation charges under all circumstances, overriding all other cancellation provisions. Applies to payment defaults, documentation errors, and third-party disruptions. The Traveller/Agent irrevocably waives all dispute and chargeback rights.
7. Medical & Emergency Related Cancellations
7.1 Cancellation Due to Medical Reasons (COVID-Specific)
Up to 100% refund may be facilitated for travellers testing positive for COVID-19, subject to submitting a valid test report from a Government of India approved laboratory prior to travel. Remittance fees, banking charges, transaction costs, and non-recoverable supplier deposits remain non-refundable.
7.2 Booking Cancellation – Due to Medical Emergency
Cancellations due to illness, hospitalization, or injury are assessed on a case-to-case basis without automatic refund entitlement. Refunds depend entirely on supplier approvals and recoveries. Non-refundable bookings remain strictly non-refundable.
8. Modification & Operational Changes
8.1 General Amendment Clause
Amendments require 48–72 hours processing and are not guaranteed. Permitted changes incur supplier penalties, fare differences, re-issuance fees, and administrative costs. Promotional discounts and sponsorship benefits do not carry forward.
8.2 CRS / Quote Updates (Customer Requirement Sheet)
The CRS is the primary planning document. Revisions to dates, passenger details, or inclusions supersede prior quotes and may cause price escalations or inventory loss.
8.3 CRS Updation – No Price Change
Minor adjustments (sequencing, non-cost room configuration) are accommodated subject to supplier feasibility without entitlement to price reductions.
8.4 CRS Updation – With Price Change
Material changes in dates, destinations, or duration require full payment of the cost difference prior to confirmation. Non-compliance leads to booking release.
8.5 Name Change Clause & Transfer of Services
Name changes are highly restricted on flights, ferries, and hotels. Passenger substitutions are treated as cancellations and re-bookings at full charges.
Name Correction vs Name Change: Minor typographical rectifications (spelling, title) qualify as corrections subject to documentation verification. Full substitutions constitute a Name Change with full cancellation penalties applying.
9. Re-Issue of Services
9.1 General Re-Issue Clause
Re-issuance requires 48–72 hours offline processing and attracts supplier penalties, fare differences, re-issuance fees, and forex costs. Parity of original configuration is not guaranteed.
9.2 Service-Specific Re-Issue Provisions
- Flights: Subject to airline fare classes; promo/LCC tickets are generally non-reissuable.
- Hotels: Subject to contract rate plans and room availability.
- Ferries: Subject to manifests, tides, and weather constraints.
- Land Services & Add-Ons: Time-bound tickets/visas are non-reissuable once finalized.
9.3 Re-Issue of Flight Service Bookings
Governed strictly by airline change penalties and live seat availability. Missed flights or no-shows are non-reissuable.
9.4 Re-Issue of Hotel Service Bookings
Subject to room category availability and revised seasonal rates. Requests submitted within restricted cancellation windows attract 100% retention.
9.5 Re-Issue of Land Service Bookings
Tours, entry tickets, and transfers once booked are non-reissuable and non-refundable.
9.6 Re-Issue of Ferry Service Bookings
Water-based transfers are non-transferable and non-reissuable once passenger manifests are finalized with operators.
9.7 Re-Issue of Ground Services & Hotel Bookings
Refer to Clauses 9.4 and 9.5 in conjunction.
9.8 Re-Issue Confirmation (Reset Booking Confirmation)
Re-issuance is finalized only upon written acceptance and full payment of differential charges. Once re-issued, revised terms supersede all prior arrangements.
10. Termination of Tour & Services (Post Commencement)
10.1 Termination of Tour & Services – On Bad Behaviour
The Company reserves the right to terminate services immediately without refund for abusive language, harassment, legal violations, or property damage. 100% retention applies, and all repatriation/legal costs are borne by the traveller.
10.2 Termination of Tour & Services – Non Clearance of Dues
Outstanding balances during a tour trigger immediate service suspension (hotel check-out, transfer cancellation) with 100% retention of booking costs.
10.3 Termination of Tour & Services – Services Revoked for Resolution
Temporary suspension of services may occur for documentation, dispute, or payment verification. The Company bears no liability for resultant delays.
11. Financial Settlement & Refund Handling
Refunds are initiated only post-reconciliation and deduction of cancellation fees, supplier deductions, transaction charges, and currency conversion (ROE) spreads. Refund amounts may be lower than original sums paid or issued as credit notes, with no Company liability.
12. Protection, Risk & Liability Clauses
12.1 Insurance
Comprehensive travel insurance is strongly advised. Insurance claims are handled directly between the User and insurer; the Company bears zero financial liability for insured losses.
12.2 No Liability & Waiver
The Company disclaims liability for supplier defaults, insolvency, delays, personal injury, illness, or property damage. Travellers irrevocably waive claims arising beyond direct Company control.
12.3 Customer Assurance & Flexible Services Clause
Select partnered resort bookings offer 100% refundable cancellation up to 48 hours prior to check-in, strictly subject to supplier confirmation. Unused land components must be cancelled 48 hours prior to service commencement.
